The term “MINDFULNESS ACADEMY” or “us” or “we” refers to the owner of the website, Mindfulness Academy PLT, a registered entity in Malaysia. The term “you” refers to the user, viewer, or student of our website and professional programs.

Mindfulness Academy provides this site and its professional academic services (including EMBA and EDBA modules) subject to the terms contained in this agreement. If you do not agree with any of these terms, do not access or use this site. Your use of this site shall be deemed your agreement to abide by each of the terms set forth below.

Mindfulness Academy grants you a personal, non-transferable, and non-exclusive right to use its educational materials on any personal media device, provided that you do not copy, modify, create derivative works from, or distribute any content for commercial gain.

Your privacy is very important to us. Users should refer to our Privacy Policy for information about how we collect and use personal information. By accepting this agreement, you consent to Mindfulness Academy's disclosure and use of your information as described in said policy.

The creation of an account is compulsory to access course materials or purchase programs. You are responsible for maintaining the confidentiality of your password and account. You agree to immediately notify Mindfulness Academy of any unauthorized use of your account. We will not be liable for any loss arising from your failure to comply with this security obligation.

You acknowledge that all content, including but not limited to text, data, course modules, graphics, and logos, is protected by Malaysian and international copyrights and proprietary rights. You may not publish, reproduce, or distribute any content received through this site without the express written authorization of Mindfulness Academy PLT.

You agree not to use the website to:

• Upload or transmit any content that is defamatory, unlawful, or plagiarized.
• Infringe upon any patent, trademark, or property right.
• Distribute viruses or harmful programming routines.
• Engage in any activity that interferes with the learning experience of other students.

As a professional academy, we maintain the highest standards of academic honesty:

• Plagiarism: The act of using other people’s words or images as your own is strictly prohibited.
• Collusion: Unauthorized collaboration between students on individual assignments will result in penalties.
• Cheating: Any attempt to gain an unfair advantage in assessments will lead to immediate account suspension and disqualification from the program without refund.

• Refunds: Once payment is received and digital products or modules have been delivered to the student’s dashboard, refunds are not available.
• Access Period: Access to professional modules and assessments is limited to the duration specified at enrollment (typically 5 years). Extensions are granted only under exceptional circumstances at the Academy's discretion.
• Payment Failure: Failure to maintain monthly installment payments (where applicable) may result in an administrative fee and temporary suspension of account access.

• Accreditation: Where applicable, courses are accredited by professional bodies chosen by Mindfulness Academy. If there is a change in the validating partnership, the Academy will ensure the new body meets an equivalent standard.
• University Admission: Mindfulness Academy provides the academic foundation for progression; however, we in no way guarantee direct progression into a University Degree or Master’s program. Admission depends solely on the student’s experience, application, and the specific requirements of the receiving university.

Mindfulness Academy makes no warranties about the accuracy or completeness of the website's content. We shall not be liable for any direct, indirect, or consequential damages resulting from errors, system interruptions, or the use of our educational materials. Use of the website and its content is at your own risk.

These Terms and Conditions are governed by and constructed in accordance with the Laws of Malaysia. Any disputes associated with these terms will be subject to the exclusive jurisdiction of the courts of Malaysia.

In compliance with the Personal Data Protection Act (PDPA) of Malaysia, Mindfulness Academy treats all personal data confidentially. Your data is used only for the fulfillment of the educational contract and is not shared with third parties except for payment processing and necessary academic validation.
